This is interesting. I got a letter from the Golf Digest lawyers today claiming trademark infringement and unfair competition because I used a cover image of their magazine in an Amazon affiliate link I built to promote their magazine.
Any suggestions on how to respond?
...use of the Golf Digest covers to implore users to purchase a magazine subscription at www.Amazon.com for your referral fee, suggests some affiliation or association with these magazines. From the context of your site, consumers are led to believe that www.watchingtytryon.com has some relationship with GDC to supply material from the publications and/or share proceeds from magazine subscription sales. Such use of our client's marks and cover images constitutes unfair competition and trademark infringement in violation of Federal and state laws. These laws also provide significant remedies for infringements such as yours. |

Did you scan the cover, or are you getting the img from Amazon?

| send it to amazon. amazon claims we can use the artwork. if this is not true there are 900,000 copyright violators out there! I personally don't see a problem with promoting their product, but I guess they think they can sell enough without the help of affiliates........ Maybe they don't like the competition on the site (assuming there is any)??? |

| Its a cover I got from the Build-a-link section of the Affiliate website. I did copy it to my server first, but hardly think that matters. |

I would say use the link I posted so that the graphic doesn't actually live on your server (so they cant claim you have an illegal copy). And then refer the matter to Amazon. |

| we arent' supposed to link directly to the images on amazon's server, but this may change the entire linking system in the program :D..... no more wasted bandwidth and disk space for us!!!! |
